Funding: This item is projected to result in additional revenue of $200,000 in the Operating Budget of Austin Convention Center when the new convention center is in operation.

The proposed license agreement is for the high-density installation of access points around the Austin Convention Center, Palmer Events Center and the Warehouse Marshalling Yard facilities in the ceilings of pre-function areas, event halls, ballroom, meeting rooms, and offices via a Distributed Antenna System (DAS). Licensee will accept the premises in its existing “as-is” condition and will be solely responsible for all costs associated with the installation, operation, maintenance, repairs, replacements, and removal of the DAS. The DAS will consist of three vendor Intermediate Distribution Frames (IDF), each containing a single device rack. Licensee’s IDF will have approximately six racks for Licensee’s equipment. Licensee may engage up to three cellular service vendors to provide service under the DAS in all ACC Facilities. Each rack housing Licensee’s or vendor’s equipment will be provided by Licensee and will have a footprint of 3' x 3' and height of 7'. Licensee’s initial capital investment to install the DAS is estimated at $500,000.
Licensee will be solely responsible for all permitting, design, construction, operation, maintenance, repair, replacement, insurance, utilities, and future removal of the authorized equipment. City retains ownership of designated permanent infrastructure as provided in the License Agreement, while Licensee-owned telecommunications equipment remains the responsibility of the Licensee. The agreement places all operational and financial responsibility for the DAS improvements on the Licensee and requires no capital investment by City. Revenue will be determined on the consumption of power and fiber used by Licensee and calculated based on Fee Schedules approved annually by Council. ACC will invoice Licensee monthly for fees due.
Approval of this item will authorize execution of a License Agreement with Licensee to allow cellular connectivity planning and implementation within the new convention center as it is being developed, and support event-related activities, maintain reliable cellular service at remaining ACC Facilities while generating revenue to help fund City operations of the Austin Convention Center Department. ACC projects generating $200,000 of revenue annually.
