The requested action is for Council to ratify the contract with M.A. Smith Contracting Co. Inc., which has been procured under authority of Section 252.022(a) (2) of the Texas Local Government Code as a procurement necessary to protect or preserve the public health and safety of the citizens of Austin.
The Little Walnut Creek Flood Risk Reduction project reduces the risk of interior flood inundation to as many structures as possible, reduces the floodplain footprint, and reduces bridge and roadway flooding.
Project construction started in May 2021. Due to delays in the performance of work, the contract was terminated by mutual agreement in April 2023. In March 2023, staff initiated a Certificate of Exemption under Section 252.022(a) for Health and Safety due to the state of the project posing a threat to public safety and the environment. The site’s location within the right-of-way and parkland created a public safety hazard and the incomplete storm infrastructure posed threats of flooding and water pollution.
The City entered into an agreement with M.A. Smith Contracting Co. Inc. in June 2023 to continue the project and complete construction. The work remaining to be completed included reconstructing the pavement along Mearns Meadow Boulevard, completing installation of the new flood control box culvert bypass along Mearns Meadow Boulevard, installing flood bypass weir structures at Mountain Quail Road and Quail Valley Boulevard within Little Walnut Creek, completing installation of new wastewater lines, pond grading, and stabilizing the pond inlet and outlet structures. The project is substantially complete and is now in post-construction phase.
