December 14, 2023 - Resolution No. 20231214-060 authorizing negotiation and execution of an advance funding agreement with the Texas Department of Transportation for engineering and design study for cap and stitch improvements on the IH-35 Capital Express project for a total estimated cost of $1,818,334 with the City’s share of the costs estimated to be $166,667 plus any cost overrun was approved on consent on a 10-0 vote with Council Member Ryan Alter absent.
December 14, 2023 - Resolution No. 20231214-061 authorizing negotiation and execution of an advance funding agreement with the Texas Department of Transportation for the City to contribute $15,445,000, for 30% of the design and other associated costs of cap and stitch structures to be integrated into the IH-35 Capital Express Central Project was approved on consent on a 10-0 vote with Council Member Ryan Alter absent.

Staff is requesting Council authorization to negotiate and execute an advance funding agreement with the Texas Department of Transportation (TxDOT) for the City to contribute funding to complete 100% the design work that is underway now for future caps and stitches. Funding for this item comes from the State Infrastructure Bank Loan, or other funding sources.
This action is a follow up to the November 7, 2023, Council briefing wherein staff shared TxDOT’s deadline and milestones for funding and delivering City-funded cap and stitch improvements. As discussed during that briefing, the deadline for commitment to fund 30% design and environmental clearance for City-funded caps and stitches was December 2023. These funds have been spent. TxDOT has completed the 30% design and shared the documents with the City in October 2024. The deadline to fund the remaining balance of up to $19,000,000 for 100% design is December 2024. The design fee number will become more accurate after Council provides clarification on how the Cap and Stitch Program should move forward during the December 12, 2024, Council meeting. These funds will be spent through 2026, aligning with TxDOT’s CapEx-C design milestones and schedules.
