Approve a resolution authorizing the filing of eminent domain proceedings and payment to acquire the property interests needed for the Williamson Creek Interceptor Project for the public use of replacing a wastewater tunnel to increase the capacity to accommodate future growth in the Williamson Creek basin, requiring the acquisition of one wastewater easement being a 0.006 acre (288 square foot) tract of land and one temporary working space easement being a 0.022 acre (980 square foot) tract of land, both being out of Lot 1, Battle Bend Subdivision, recorded in Volume 87, Page 117C of the Plat of Records of Travis County, Texas, currently appraised at $92,924 subject to an increase in value based on updated appraisals or a Special Commissioner’s award. The owner of the needed property is Munday Trust Number One. The property is located at 5306 South Interstate Highway, Austin, Texas 78745. The general route of the project is along Williamson Creek, from South 1st Street to South Pleasant Valley Road.

This wastewater easement acquisition is required for the installation of a new gravity wastewater interceptor along and near Williamson Creek, from South 1st Street to South Pleasant Valley Road. The existing wastewater pipeline in Williamson Creek is reaching the end of its useful life and capacity as growth continues in the area. This project is proposed to be funded in part by the Texas Water Development Board’s Clean Water State Revolving Fund and by Capital Improvement plan dollars.
This project will install over 19,800 linear feet (3.75 miles) of wastewater interceptor and 22 connection locations to divert localized wastewater flows to the new interceptor. This project also includes proper abandonment and removal of most of the existing interceptor and environmental restoration of any affected project areas.
The City has attempted to purchase the needed property at 5306 South Interstate Highway, Austin, Texas 78745. The City and property owner have been unable to agree on the value of the needed acquisition. The Law Department is requesting authorization to file an action in eminent domain on behalf of the City, and to authorize the City to pay for the property interest in an amount determined by the appraisal, updated appraisal(s), or a Special Commissioners’ award.
