If approved, this item will disannex approximately 3.7 acres in District 10 in Austin. The subject properties are located on the south side of River Bend, adjacent to Lake Austin. Portions of the properties are located in Austin’s full purpose jurisdiction, which comprises the area eligible for disannexation.
Texas Senate Bill 1844, which amended Texas Local Government Code Section 43.141 (Disannexation for Failure to Provide Services) and took effect September 1, 2025, allows a majority of the property owners of an area to petition the governing body of the municipality to disannex the area if the area is located adjacent to a navigable waterway and the municipality has not connected the majority of the properties in the area covered by the petition, regardless of whether the area was annexed by the municipality, to the municipality’s water and wastewater systems, if any other area in the municipality is connected to the municipality’s water and wastewater systems.
On May 18, 2026, the City Clerk received a petition for the disannexation of 12 properties. Subsequently, six properties were withdrawn from the petition. City staff has reviewed the petition and has determined the validity under the requirements of state law for the remaining six properties.
