September 30, 2021 - Council authorized the negotiation and execution of an amendment to the community facilities agreement with South Lamar Owner, LLC.

The Watershed Protection Department has a capital improvement program (CIP) project, subproject ID 5789.069, West Bouldin Creek - Del Curto Storm Drain Improvements, to improve stormwater conveyance in the Del Curto area. The developer of 2323 South Lamar (Site Plan SP-2019-0599C) entered into a community facilities agreement with the City of Austin as part of meeting drainage criteria requirements. Issues encountered during construction and economic changes have resulted in the costs being greater than anticipated in 2020 and additional authorization is being requested. The project is in Council District 5.
The City has determined that it will derive a benefit from the construction of the proposed improvements in accordance with the terms of the proposed agreement and the requirements of Texas Local Government Code Chapter 212, Subchapter C (Developer Participation in Contract for Public Improvements).
