The Texas Emissions Reduction Plan is a state program administered by the Texas Commission on Environmental Quality (TCEQ) to improve air quality by reducing nitrogen oxide (NOx) emissions through a variety of incentive programs, including grants for replacing older, high-polluting vehicles and equipment with new, cleaner models. The TCEQ issued an Emissions Reduction Incentive Grant to the City on June 16, 2005, in the amount of $205,000 for six refuse trucks based on fuel usage. The City did not meet the emissions reductions required by the grantor because the refuse trucks did not meet the fuel usage throughout the activity life of the contract and one of the City’s refuse vehicles was out of service between January 1, 2011, and December 31, 2011.
