Prior Council Action:

August 29, 2024 - Council approved Ordinance No. 20240829-154 repealing and replacing portions of Ordinance Nos. 20071018-008, 20191114-068, and 20210304-079, electing to participate in the Enterprise Zone Program, and setting out the incentives for the program.

Ordinance No. 20240829-154 repealed and replaced prior ordinances authorizing participation in the Enterprise Zone Program and setting out the local incentives for Enterprise Projects approved by the Governor’s Office of Economic Development and Tourism. This action was necessitated by a 2023 amendment to Texas Government Code Chapter 2303, Subchapter F permitting applications to be submitted electronically. The State subsequently requested that local governments update their ordinances to reflect the amendment and Council did so by approving Ordinance No. 20240829-154, which mirrored the language of the sample ordinance provided by the Office of the Governor. However, it was subsequently determined that the sample ordinance did not include all the local incentives allowed by law and that its use could result in a loss of points for the City’s nominations. Accordingly, this ordinance amends Ordinance No. 20240829-154 to list all  local incentives that the City may provide under the Enterprise Zone Program.
