Texas Senate Bill 1844 (89th Regular Session), which amended Texas Local Government Code Section 43.141 and took effect on September 1, 2025, allows a majority of the property owners of an area to petition the governing body of the municipality to disannex the area if the area is located adjacent to a navigable waterway and the municipality has not connected the majority of the properties in the area covered by the petition, regardless of whether the area was annexed by the municipality, to the municipality ’s water and wastewater systems, if any other area in the municipality is connected to the municipality ’s water and wastewater systems.
On November 3, 2025, the City Clerk received a petition for the disannexation of 12 properties along Lake Austin; subsequently, the applicant agreed to withdraw four properties from the petition. City staff reviewed the petition and determined that it complies with state law as to the disannexation of the remaining eight properties.
