Approve an ordinance amending Ordinance No. 020801-15, which settled disputes regarding the applicability of the Save Our Springs (SOS) Ordinance in the area known as Circle C, to adopt an amendment to the settlement agreement for Tract 110 (11010-1/2 South Mopac Expressway Southbound) to increase the development density for residential living units and multifamily residential living units and to remove the requirement for the property owner to construct the South Bay Lane Extension on Tract 110; and authorizing the execution of the amendment. This action concerns land located within the Barton Springs Zone. Funding: This item has no fiscal impact.

In 2002, the City and Circle C Land, L.P., a Texas limited partnership, formerly known as Circle C Land Corp., a Texas corporation (“CCLC”), entered into a development agreement that settled a dispute between the City and CCLC related to the applicability of the City’s Save Our Springs (SOS) ordinance. The development agreement establishes limits on the development density for office, retail, residential and multi-family residential development. It can only be amended by mutual agreement of the City and the property owner.
CCLC is requesting Council agree to amend the development agreement for a portion of Tract 110 to allow for one or more multi-family residential developments and to remove the requirement for CCLC to construct the South Bay Extension on Tract 110. If approved, this ordinance will amend the development agreement related to Tract 110.
