Authorize negotiation and execution of a contract with RFD & Associates Inc. to provide an ethics electronic filing system, for a term of five years in an amount not to exceed $1,065,000.
(Note: Sole source contracts are exempt from the City Code Chapter 2-9C Minority Owned and Women Owned Business Enterprise Procurement Program; therefore, no subcontracting goals were established).

Fiscal Note
Funding in the amount of $150,000 is available in the Fiscal Year 2021-2022 Operating Budget of the Office of the City Clerk. Funding for the remaining contract term is contingent upon available funding in future budgets.

The contract is for an ethics electronic filing system. Mayoral and Council candidates and political action committees are required to file all campaign finance reports, including City forms, financial disclosure statements, and lobbyist registration, using the City e-filing system. The system allows filing of reports from any location. These reports are mandated by the State Election Code, Section 254.063 and 254.093. The Texas Ethics Commission (TEC) and RFD & Associates, Inc. designed a system to meet the Texas specific campaign filing requirements that local government agencies must also follow.
RFD & Associates, Inc. is the sole provider of the ethics e-filing system used to comply with state filling deadlines. TEC does not release the system through any other source.
